REGIONAL LAND USE COMMITTEE (RLUC)
E.O. 124 “Establishing Priorities & procedures in Evaluating Areas Proposed for Land Conversion in Regional Agri-Industrial Centers/Regional Industrial Centers, Tourism Development Areas and Sites for Socialized Housing” dated 8 September 1993.
EO 124 provides (Sec. 2.1.a) that the Regional Development Councils convene their Regional Land Use Committees. The RLUC replicates the NLUC at the regional level. The RLUC is a policy-making body. Regional land use plans formulated shall serve to indicate and recommend, and not to mandate, the use of individual parcels of private lands, except as may otherwise be prescribed, by specific laws (Sec. 2 of LO1 1350 “Providing for the Institutional Framework for National Physical Planning”)
Composition (Sec. 2.1.b of EO 124)
The RLUC shall have as members the Regional Directors of DA, DAR, DENR, DILG, DPWH, DOST, DOTC, DTI, DOT and HLURB. It shall have two representatives from NGOs, people’s organizations and the private sector to be selected by their respective RDC.
The RLUCs are empowered to call upon any government agency including GOCCs and other government entities to assist in their work.
The Regional Director of the NEDA shall serve as Chairman. The HUDCC shall be the Co-Chairman. A Vice-Chairman shall be selected from among the members of the RLUC. The NEDA shall provide the necessary Secretariat for the Committee.
Functions/Responsibilities (Sec. 2.1, EO 124)
The RLUC shall be primarily responsible for the evaluation of priority development areas for land conversion as identified by the DTI, DA and DOT. The evaluation shall be undertaken in close coordination with LGUs concerned. The RLUCs and concerned government agencies shall evaluate whether the priority development areas for land conversion are:
a) non-negotiable for conversion as provided for in AO 20, s. 1992 as determined by the DA;
b) already distributed subject to Sec. 65 of R.A. 6657 or covered by a notice of acquisition or voluntarily offered for coverage under the CARP as determined by the DAR. In case a site falls within these areas, alternative industrial or tourism sites shall be identified by the RLUC in close coordination with concerned LGU and lead agencies.
The RLUC, through their respective RDCs, shall submit their recommendations to the NLUC within three months upon submission of the proposed sites.
Sec. 2 of LOI 1350 also provides that the Committee shall utilize as much as possible the services of the various Regional Development Councils in determining and building up such regional informational and data requirements as it may require. Decisions concerning land use policies at the regional level shall as a general principle be discussed and resolved, as much as possible, in the appropriate Regional Development Councils.
Chapter IV of the Central Luzon RPFP 1993-2023 provides that the Central Luzon RLUC shall have following functions:
a) Prepare, integrate and periodically revise the Regional Physical Framework Plan consistent with the Regional Development Plan for presentation and approval by the Regional Development Council;
b) Coordinate and integrate all physical planning activities in the region;
c) Provide technical assistance to local government units in the preparation of their physical plans;
d) Coordinate related researches and surveys undertaken by various agencies.
Technical Working Group
To assist the RLUC in the performance of the above activities, it shall be backstopped by a technical working group composed of senior technical staff of member agencies. The TWG shall be subdivided into four subcommittees to address the four concerns of the RPFP: Production Land Use; Protection Land Use; Settlement; and, Infrastructure Support.
The NEDA Region III Office shall head the TWG. It shall likewise be the depository of data and maps relevant to physical planning.
